Spoiler: It is not, WhiskeyLeaks is just trying to set the stage for impressionable soldiers that you will be punished if you don’t do what they tell you no matter what. He is untouchable. He’s retired, he’s free to do whatever he wants. Hegseth is trying to do a 3D chess move by saying that since we are in an emergency situation, he can call Kelly back to active duty and while being in active duty, he can be court martialed for insubordination for saying bad things about Trump. It’s a complete BS move that won’t work.
Hegseth will lose this case and he knows it. It’s just bluster. He’s even said the same thing he’s supposedly mad at Kelley for saying.

Consider the absurd: you served in the US military long enough to earn a pension, then left the country and joined an evil terrorist organization waging violent war against the USA.
Should the US still need to pay out your pension, or should there be a way to cancel or suspend it for your treasonous acts?
It seems like that call should be made by the court or Congress, not unilaterally by your former employer.
Not that senator Kelly is at all being fairly treated by the facists in charge, mind you. But the lever they’re pulling is one that exists for an intentional reason.

But Kelly will not lose his pension until they go through a lengthy and complicated legal process where probably at least 1 judge will decide if Hegseth is full of shit, which he obviously is
